This is a quick note, because I am studying and struggling. Heavy!!!
Just to give you all the latest up date, which you all will not believe, I was shocked when the letter came through the post.
Remember the story “Party Signals Ignored”, well it’s a follow up.
This is a signal everyone of us missed, suppose readers did as well.
The police came up to my door and asked me this question,
“Did he force your head on floor or whilst he was standing”,
I replied,
“I don’t know, front think why are you asking”,
They replied,
“It doesn’t matter then walked away”.
So I never thought anything of it, bit strange, but its local police. J
Two weeks later, a letter came in the door from Inverness Court, I just guessed it was one of the males getting done for assault.
I done quick read through, Blah…. Blah…. Blah….Bl… Sexual Assault… Blah.. Bl….. Wait rewind, …….Sexual Assualt, What!!!! I am the main witness…
You got to be joking, I never phoned the police for Sexual Assault, and I bloody freaked out.
Within seconds I phone the solicitor, and told him about it. I told him, I never phoned the police for Sexual Assault, they called me down last year, and asked about that night. I asked them who was getting done, and they would not tell me. If I know this was going to happened I would said nothing at all, I thought a guy was getting charged for assault.
I told Solicitor Mr Knoculous, nice guy, I wanted nothing to do with this. So he told me to drop the letter in at his office, and he will have a read of the story, save time me explaining it to him.
Next day I phoned the guy who booked me, he said that he never phoned the police, Phone the African or Black guy (don’t give any political correctness please), he never phoned the police. The African guy told me that the police asked him for a statement few months ago also. We all found out that someone must have phoned the police outside when they were fighting, police took all statements and decided themselves.
I got hold of the guy accused and told him, I have nothing to do with this, I never phoned the police and either did the others. He was upset, because he was that drunk he could not remember.
I can understand drunken disorderly, or assault, but sexual assault, taking it to far. You got to be kidding, having that on your record.
So solicitor wrote the letter, explaining all, and me not wanting anything to do with this. I don’t know exactly what was on the letter. But I told Mr knoculous that if he gets done, we might as well do 70% of customers, because you always get one Dick in a crowd, who does go over the top and over pissed. I would not go to court. It’s just something that happens often.
Mr Knoculous phoned me and told me to phone this Victim support in The Court (whatever).
“I am not a victim”, but he explained that I had to give them details and maybe they could help, and what was rather amusing, I can’t say word for word, but it was something as,
“Now stay calm when you speak to them”.
So I phoned them up, and explained it all. What a smarmy little **** she was.
“The police decided and that is it”,
I said to her
“But I haven’t made any complaint, I will just not turn up then”,
Her reply was, something towards
“Well, that is the way it has to be, if you don’t turn up you will… (can’t remember) think arrested or warrant out, whatever, can’t remember.
I was freaking out, I am not getting anyone done for Sexual Assault. I know he was an arse and over drunk, but my only main concern was the fight and the blood, which upset me.
I told the guy to keep pleading Not Guilty, because I will happily stand up and court, let them know my opinion on this, wasting my time, tax money and strongly advise them to go and catch real criminals, etc
We got into this week, case still going forward. F*** Sake…Suppose to be this week, so I phoned up the court last week, having a go, telling them that they are wasting my time, when nobody in the party phoned the police, nobody phoned police for sexual assault, so why is he getting charged and the main witness is saying he didn’t..
The rule now as Mr knoculous said, the police can charge someone without anyone phoning and complaining, or making charges.
Court was suppose to me on Thursday, I spoke the guy who was getting charged and told him not to worry, because I will let them know, I do shows, if he gets done you will need to find the other customers and charge them. I can understand Drunken Disorderly, but Sexual Assault is going to far, …… nope never seen him in my life.
Poor guy was worried. I told him to get his solicitor to phone me, and I can tell him, this is going to far, I have not made any complaints to the police whatsoever.
The guy actually told me that the police up his end doesn’t like him, he thinks they are personally out to get him themselves.
Wednesday morning I received a phone call from procurator fiscal, I actually thought she was a sales woman, I was going to tell her to “Get lost, I’m busy”, because the number shown started with a 0845… just second before she introduced herself.
She told me he was not getting charged.
I thanked her very much, what a relief. All that months of worry, glad, I want nothing do do with this little scam of the police.

The Sheriff admonished him. This is a warning …..It will be taken into account if he is convicted again. This mean you do not have to attend court…..
Then you get “Offer emotional support”,
F*** off, nobody is emotional disturbed, well not in this case, only emotional disturbance I have is this guy getting charged when nobody made a complaint about Sexual Assault. What really pissed me off, they still quote it appears on his record….
Just shows, I can understand if I made the complaint, but I never did, and neither did any of the others at the party. The police just came around and took statements from everyone told the same as myself, why the fight started, and before you know it someone is getting charged for something we all missed.
ONE SIGNAL EVERYONE MISSED!!! I AM STILL PISSED OFF ABOUT IT!!!!!
WHEN YOU DO MAKE COMPLAINTS THEY DON’T BOTHER, DO NOTHING….. WHEN NO COMPLAINTS THEY GO OUT OF THERE WAY TO CHARGE!!!
